Job description: Job Summary Our client in the Construction Industry is looking to hire a Commercial Executive.Duties and Responsibilities
- Review tender bid submissions from a commercial and risk perspective
- Draft, or oversee and approve the drafting, of Platform construction contracts with the assistance of the Group Legal Manager as and when necessary
- Draft, or oversee and approve the drafting, of Platform legal, dispute, claim notification and contractual letters regarding material commercial matters.
- Support, and lead if necessary, the successful resolution of material commercial negotiations, claims and disputes.
- Ensure that the Platform’s commercial and contractual entitlements are optimised, dealt with promptly and in accordance with the relevant conditions of contract.
- Develop and implement commercial strategies according to the Platform’s goals and
- objectives.
- Take responsibility for the commercial, risk management and quantity surveying functions within the Platform – and guide the competence, productivity, and transformation of the staff within these functions.
- Provide commercial advice, guidance, and support to sites from award to final account stage to enhance project value; and conduct monthly reviews of commercial performance.
- Assist in setting financial targets, and budget development and monitoring.
- Keep updated on changes in relevant laws, standard contracts and maintaining commercial management best practices.
- Monitor and oversee compliance with relevant Group and Platform policies and procedures.
Knowledge and Skills
- Extensive knowledge of South African laws, regulations, and practices applicable to construction contract preparation, negotiation, and administration. A working knowledge of relevant legislation in the SADC region would be an advantage.
- Extensive knowledge and understanding of construction contracts i.e. FIDIC, GCC, NEC and JBCC. A working knowledge of SANS 1200, COLTO (and/or COTO) would be an advantage
- Working knowledge of the CCS Candy estimating and Site plan programming system
- Excellent negotiation and dispute resolution skills
- Good communication and presentation skills with ability to provide advice (orally and in writing) and influence decision making
- Strong interpersonal skills with the ability to work independently and with, and as part of, various
- and diverse departments and teams
- Strong analytical and problem-solving skills – with attention to detail
- Undertake duties with objectiveness, integrity, and professionalism
- Commercially astute with an understanding of financial statements (IFRS) and relevant forms of insurance
- Ability to compile, analyse and enhance project risk documentation and processes
- Excellent ability to review and formulate various forms of contracts and agreements
- Commercially astute and ability to understand financial statements (IFRS)
Requirements
- A quantity surveying or civil engineering degree, or similar qualification
- A post-graduate degree or diploma in a related field such as arbitration or construction law
- Registration with a relevant professional body would be an advantage
- A minimum of 10 years’ senior construction commercial experience, preferably with exposure to large civil engineering projects. Exposure to large building projects or developments would be an advantage.
- A minimum of 15 years’ overall construction industry experience
- Quantity surveying and risk management experience in the construction industry would be an advantage
- Experience in mediation, arbitration, adjudication, and other forms of dispute resolution, related legal processes,
- Experience with FIDIC, GCC, NEC, JBCC and associated subcontract agreements – as well as bespoke forms of contract
